Can someone please explain how the violent rape of a woman and conning a hedge fund out of money can possibly be on the same page in the sentencing handbook (if there is such a thing)? Does someone, somewhere who has a very important job title look at those two offences and thinks ‘yep that’s fair’? If so, he should be summarily fired and forced to track down his lost marbles! What am I ranting about? Sorry, yes, I should probably explain…..

This tells the story of a guy who was pretty much broke, surviving only on State handouts, but who is a World class liar. He convinced some extremely wealthy people to give him lots of money by telling them that he was a confidante of the rich and famous; he span a tale of life as a super rich philanthropist while living in a council house in Wales. The one question that immediately sprang to my mind was ‘why did no-one check this guy out’???? However wealthy a company, do they seriously just hand over £1 million without doing any kind of background check???? How daft can you get?

This chap is a complete fantasist and a conman who committed a crime, yes, but does he deserve to go to prison for 8 years? The company got most of its money back; really, who was hurt?

On the other hand we have a guy who raped a woman who was on her way home. He attacked her when she was alone, at night. He grabbed her by the hair, threw her on the ground, punched her in the face and then raped her. This memory will stay with her for the rest of her life; she has been violated in the worst way possible. Her physical scars will quickly heal but the emotional ones will be raw and painful for many years to come.

What sentence was handed down to the animal that did this to her? 8 years.

I realise that there is often far more to these cases than is reported in the media but can anyone please explain the logic here? For me, there is none and I am sad that we live in a World where taking cash carries the same penalty as rape.

  1. I think rape should attract a much longer jail sentence that taking cash. Cash can be replaced and given back but a woman who is injured and raped has been given a life time sentence that can never ever be replaced.

  2. You are right, these both were crimes, but rape is by far more heinous crime. It should be punished in a way that it would be deterrent for others. 20 year to life, that’s what I think.

      I’m not sure if the threat of long prison terms actually works as a deterrent for rapists as the death penalty doesn’t work as a deterrent for murderers but, as we don’t have a viable alternative…….

Prison is NOT prison anymore…it is a gloryfied holiday ….. it is beyond me how the government has allowed the prison services to get as bad as they are…prisoners ‘rule the roost’ and the guards seem to be at their mercy…it is shocking….so I agree, prison terms do not seem to be working and sentences DO NOT FIT THE CRIME…..

  3. It is lucky in this case there was some kind of justice at all. Often there isn’t. My view is more towards “Justice has to be seen to be done.” The way it is interpreted means the police will act if there is some publicity. If not kiss justice goodbye. It more about managed public profile of the police rather than doing a proper job imo. occasionally justice happens.

  4. Obviously you are right in that there is no comparison between the seriousness of the crimes.
    I have never seen any evidence that rapists can be reformed so I would go for full life terms.
    In fact, given the trauma on the victims of ANY crimes of violence I think sentences for them should be much higher.

  5. When I was young and inexperienced in life (around 20) I was fined for driving a few miles an hour over the speed limit. From memory I think the fine was £36. On the same day I remember a judge giving a suspended sentence to a man for stabbing another man in the back with a knife. The judge reasoned that the sentence was suspended because the guilty man was drunk at the time. I felt that I’d been penalised more than a person who’d actually stabbed someone else. Since that day several decades ago I’ve realised that the justice system and justice are certainly not one and the same.

  6. This is where my personal zapper comes into its own. I still have to perfect it, but it is effective for a whole range of things. From a zapping of car stereos so they never, ever work again when music is played at such a level as to obliterate my eardrums, to a zapping of mens private parts so they no longer exist after a conviction for rape. There are numerous variations from a mild “ouch”, to a complete annihilation. More seriously (although I would dearly love to have such a device) I would welcome the introduction of either physical, or chemical, castration for rapists, and just don’t get me started on pedophiles!

    2. I understand your point of view, but may I remind you that the vast majority of rapists do not use their penis to commit rape. This is not known to the general population but is a fact documented in the scientific literature. The rapists use objects to hurt and penetrate their victim. Castration and chemical injections that reduce libido and erections are therefore not very useful in this type of crime. We have, as your words imply, a serious need to question ourselves about violence in our society. For me, the tolerance is zero. Once, it’s already too much! In prison is where they have to go for full life.

      1. I think you’re absolutely right; rape is far more about power and dominance than sex. The problem is that the judiciary often get it wrong; there are many cases where women have cried rape where none has taken place. On the other hand there are many rapes that are not reported because women fear the judicial process. I don’t know what the answer is other than to educate, from a young age, the importance of respect

In Canada, rape is defined as “any act of sexual penetration of any nature that is committed on the person of another person by violence, coercion, or surprise.” This is a broader definition than in the UK, as it does not distinguish between the perpetrator of the crime or the victim, or the nature of the act. Thus, the act of penetration, vaginal or anal, can be achieved using any objects and is considered a rape. Thank you, Peter, for enlightening me on the difference between the legal aspects of the UK and Canada. I must say that I much prefer Canadian law since it takes into account the results of scientific studies on the subject.

  9. Off the cuff I’d say the conman should get 15 years, and the other guy should be repeatedly beaten every day for the rest of his life.

    And the dumb companies that gave the first guy his money should give the equivalent of that money to the victim of the second guy, because she deserves some good fortune to end this story.

  10. Very sad but not surprising when we live in a capitalist society. Money is Americas god essentially. If you got a lot you get off the hook, if not you’re screwed. It’s almost like they value money just as much as a human life, maybe even more. Infuriating.

  12. Great piece. Rape and conning millionaires are not as bad as each other in any possible universe. I suppose sentencing depends on how powerful the person you hurt was and not the severity of your crime. Your piece really shows how fucked up the legal system is
